1. Acceptance of Terms
By accessing or using DashScan (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including drivers who create accounts, law enforcement personnel who access documents, and any other visitors to the Service.
2. Description of Service
DashScan provides a supplemental digital display tool that allows vehicle operators to voluntarily store photographs of their driver's license, vehicle registration, and insurance card, and make them accessible to law enforcement via a QR code and PIN. The Service is strictly supplemental and informational in nature. It does not constitute an official government record, a legally recognized form of document presentation, or a substitute for any document required by law. Physical documents remain legally required in all U.S. jurisdictions.
3. Supplemental Nature; No Legal Effect
THE SERVICE IS A SUPPLEMENTAL TOOL ONLY. Nothing in the Service or these Terms shall be construed as granting any legal right to present digital images in lieu of physical documents. DashScan makes no representation that law enforcement personnel are required to accept, or will accept, documents displayed through the Service. The decision to accept or reject documents displayed via DashScan rests entirely with the officer and applicable agency policy. DashScan is not a party to any transaction, stop, or encounter between a driver and law enforcement.
4. Document Accuracy; No Verification
DashScan does not verify, authenticate, or validate any document uploaded to the Service. You represent and warrant that all documents you upload are authentic, unaltered, current, and belong to you. DashScan bears no responsibility for the accuracy, completeness, authenticity, or legality of any document uploaded by a user. Any person who uploads fraudulent, altered, expired, or another person's documents does so solely at their own legal risk and is solely liable for any resulting consequences, including criminal liability.
5. Law Enforcement Use
Law enforcement personnel accessing documents through the Service acknowledge that: (a) DashScan is a supplemental tool and physical document verification remains required per applicable law and agency policy; (b) DashScan does not guarantee the authenticity of displayed documents; (c) all access is logged with timestamp, IP address, and token identifier; and (d) DashScan access logs are available to authorized law enforcement agencies upon valid legal request. DashScan is not responsible for any law enforcement decision, action, or inaction taken in connection with documents displayed through the Service.
6. Citations, Fines, and Traffic Violations
DASHSCAN IS NOT RESPONSIBLE, UNDER ANY CIRCUMSTANCES, FOR ANY CITATION, TICKET, FINE, PENALTY, WARNING, ARREST, VEHICLE IMPOUNDMENT, LICENSE SUSPENSION, OR ANY OTHER ENFORCEMENT ACTION ISSUED OR TAKEN BY ANY LAW ENFORCEMENT OFFICER OR GOVERNMENT AUTHORITY IN CONNECTION WITH A TRAFFIC STOP OR OTHER ENCOUNTER. This includes but is not limited to: (a) citations or fines issued because the Service was unavailable, failed to load, or displayed documents that could not be verified; (b) citations or fines issued because an officer chose not to accept documents displayed through the Service; (c) citations or fines issued because uploaded documents were expired, inaccurate, or otherwise non-compliant with applicable law; and (d) any fine, penalty, or enforcement action of any kind arising from or related to a driver's decision to use DashScan. You remain solely responsible for complying with all applicable laws, including requirements to carry and present physical documents. DashScan has no control over the decisions of law enforcement personnel and accepts no liability whatsoever for their actions.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY. DASHSCAN DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME, INCLUDING DURING A TRAFFIC STOP OR OTHER TIME-SENSITIVE ENCOUNTER. SERVICE INTERRUPTIONS, NETWORK FAILURES, OR OTHER TECHNICAL ISSUES MAY PREVENT ACCESS TO DOCUMENTS. YOU ASSUME ALL RISK ASSOCIATED WITH RELIANCE ON THE SERVICE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DASHSCAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: (A) LOSS OF LIFE OR PERSONAL INJURY RELATED TO A TRAFFIC STOP OR OTHER ENCOUNTER; (B) ANY INCIDENT, CONFRONTATION, OR LAW ENFORCEMENT ACTION; (C) SERVICE DOWNTIME OR INABILITY TO ACCESS DOCUMENTS; (D) RELIANCE ON FRAUDULENT OR INACCURATE DOCUMENTS; (E) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR (F) ANY OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF DASHSCAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DASHSCAN'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID TO DASHSCAN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (II) FIFTY DOLLARS ($50.00).
9. Indemnification
You agree to defend, indemnify, and hold harmless DashScan and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) documents you upload, including any claim that a document is fraudulent, expired, or unauthorized; (c) any interaction between you and law enforcement facilitated by or related to the Service; (d) your violation of these Terms; or (e) your violation of any applicable law or third-party rights.
10. Account Security
You are solely responsible for maintaining the confidentiality of your PIN and account credentials. You agree to notify DashScan immediately at legal@dashscan.com of any unauthorized access to your account. DashScan will not be liable for any loss or damage arising from your failure to maintain account security. The PIN-based access system is a security feature but does not constitute an absolute guarantee against unauthorized access. DashScan's rate limiting and session expiration features are provided on a best-effort basis and may not function as expected in all circumstances.
11. Acceptable Use
You agree not to: (a) upload documents belonging to another person without their explicit consent; (b) upload fraudulent, altered, or falsified documents; (c) attempt to circumvent the PIN, session expiration, or other security features; (d) use the Service for any unlawful purpose; (e) resell, copy, or distribute any portion of the Service; or (f) attempt to reverse engineer, decompile, or extract source code from the Service. Violation of this section may result in immediate account termination and may be referred to appropriate law enforcement authorities.
12. Service Availability
DashScan does not guarantee uninterrupted or error-free operation of the Service. The Service requires an active internet connection and is not designed to function offline. DashScan shall not be liable for any inability to access the Service during a traffic stop, emergency, or any other time-sensitive situation. If the Service is unavailable, standard procedures for requesting physical documents apply.
13. Termination
DashScan reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time from your dashboard. Upon termination, your documents and account data will be permanently deleted. Sections 7, 8, 9, and 14 of these Terms survive termination.
14. Governing Law; Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules, conducted in English. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR CLASS ACTION LAWSUIT IN CONNECTION WITH ANY DISPUTE RELATING TO THESE TERMS OR THE SERVICE.
15. Changes to Terms
DashScan may update these Terms at any time. Material changes will be communicated via email to your registered address or a notice on the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
16. Miscellaneous
These Terms constitute the entire agreement between you and DashScan regarding the Service and supersede all prior agreements. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. DashScan's failure to enforce any right or provision shall not constitute a waiver of that right. You may not assign your rights under these Terms without DashScan's prior written consent. DashScan may assign its rights freely.
